Legal process

The following is provided as a general guide only.

The first requirement before you may become legally married is for the completion of the “Notice of Intended Marriage” (NOIM).

The NOIM must be filed with your Civil Marriage Celebrant:

  • No sooner than 18 months before the intended date of marriage
  • No less than 1 month and 1 day before the intended date of marriage

Specific documents are required for proof of identity when signing the NOIM form in the presence of  your Civil Marriage Celebrant:

  • You must provide the original birth certificates if born in Australia
  • If you were outside Australia you need your original birth certificate or overseas passport
  • If previously married, confirmation of the ending of that marriage - divorce certificate or death certificate
  • Photo identification ie current passport or driver's licence
  • Under the Marriage Act 1961 two persons under the age of eighteen cannot marry
  • Under the Marriage Act 1961 any person under the age of eighteen must obtain parental consent and approval from a Court of Law
